GENERAL

  1. All Products sold by SureCatch.com through this site are sold subject to these Terms and Conditions. By submitting your order for processing, you confirm and affirm that you have read, understood and agreed to the Terms and Conditions in the form in which they appear at the time your order is submitted for processing.
  2. SureCatch.com shall make every effort to fulfill orders placed by Customers through the SureCatch.com Purchase Order Service, but SureCatch.com shall not be liable to any person if SureCatch.com should decline to fulfill an order for whatever reason, or if SureCatch.com is unable to supply an order because of an unforeseen change to the Products, or because the Products may be unavailable, whatsoever.
  3. SureCatch.com attempts to be as accurate as possible in describing or pricing of the Products. All typographical errors or inaccuracies in the description or price of any of the Products shall always be subject to correction after discovery of the error (even after an order has been placed), and SureCatch.com shall not be liable for any loss or damage arising from any such errors or inaccuracies and you undertake to pay the difference in prices immediately.
  4. SureCatch.com has the absolute discretion to refuse the registration of a potential Customer for any reason whatsoever without giving any reason at all and to terminate registration of any of its Customers for any reason whatsoever, also without giving any reason at all.
  5. The Customer will be liable for each and every order made under his Login and agrees to indemnify SureCatch.com in full for all claims, damages whatsoever made by any third party arising from the action of any person placing orders for the Products using the Customer's Login. The Customer shall be responsible for updating his registration particulars.
  6. Access to SureCatch.com Purchase Order Service is gained through the use of a personal membership number. The Customer shall ensure that his personal membership number is kept strictly confidential at all times to prevent unauthorized use. SureCatch.com shall use its best endeavors to prevent any unauthorized entry to the SureCatch.com Purchase Order internet site. However, SureCatch.com shall not be liable for any and all damages or losses whatsoever if any third party gains unauthorized access to the SureCatch.com Purchase Order internet site. You shall immediately notify us of any unauthorized use of your account or of any other breach of security known to you.

PRICE & OTHER DETAILS

  1. SureCatch.com shall make every effort to ensure that the prices, details and sizes of the Products detailed by SureCatch.com are correct but SureCatch.com reserves the right to vary the prices, details, sizes and other specifications of the Products without notice.

PAYMENT

  1. All prices listed in this Site are in US Dollars, exclusive of goods and services tax ("GST") as well as any other applicable delivery fee, custom or excise tax that you may incur. Payment for the products you have ordered should be by way of Telegraphic Transfer, Bank Demand Draft, Cashier's Order, Local Cheque, Credit Card or by such other means of payment or remittance that SureCatch.com may prescribe from time to time.
  2. In furnishing your Telegraphic Transfer, Bank Demand Draft, Cashier's Order, Local Cheque, Credit Card and other relevant information in payment of the products you have ordered, you hereby authorize SureCatch.com to furnish such information as may be necessary to the relevant processing center for the purpose of completing this purchase.
  3. SureCatch.com will attempt to ensure careful handling of such information but you hereby agree not to make SureCatch.com assume responsibility or be liable to you howsoever for any and all losses whatsoever and howsoever arising from or in connection with such information.

DELIVERY

  1. SureCatch.com shall use reasonable endeavors to deliver Products of acceptable quality within the time frame agreed between SureCatch.com and you but SureCatch.com shall not be liable for any delays in its delivery services, if the delay is due to causes beyond the control of SureCatch.com. You are not entitled to cancel the order due to any delay in delivery.
  2. SureCatch.com can airfreight to virtually any address in the world. For international delivery, there is a good likelihood that your package will be subject to the custom, excise and/or import duties of the country to which you have your package sent and you must be fully responsible for these payments, not SureCatch.com.
  3. You may be subject to custom, excise and/or import duties and taxes, which are levied once the package reaches your country. Additional charges for custom clearance must be borne by you; SureCatch.com have no control over these charges and cannot predict what they may be. Custom's policies vary widely from country to country; you should contact your local customs office for further information before placing your order. Once an order is placed, you are deemed to have full knowledge of the custom, excise and/or import duties applicable to your package and you shall pay them.
  4. In addition, when ordering Products from SureCatch.com, you are considered the importer and you must comply with all laws and regulations of the country in which you are receiving the Products.
  5. The Customer must notify SureCatch.com immediately of any change in his delivery address.

PROPERTY RISK

  1. All risks in the Products shall pass to the Customer upon delivery to the Customer's delivery address but SureCatch.com shall retain title in the Products until such time that payment for the Products has been effected.

INTELLECTUAL PROPERTY

  1. All the intellectual property (including copyrights, trade marks) and other similar rights to all materials & information (including pictures, graphics, text, page headers, buttons, images, animated pictures & sound) found in this site are owned by or licensed to SureCatch.com and its service providers. No part or any part thereof may be reproduced, broadcast, framed, hyper-linked or transmitted in any manner whatsoever or by any means howsoever or stored in any information retrieval system without the written consent of SureCatch.com. being first obtained.

FORCE MAJEURE

  1. If the performance by SureCatch.com of its obligations under the SureCatch.com Purchase Order Service is prevented by reason of "force majeure" (which shall include prevention occasioned by fire, casualty, accident, act of God, natural disaster, war, any law, order, proclamation, regulation, demand or requirement of the government of Singapore or by any of its government agencies, strikes, labour disputes, shortage of labour or lack of skilled labour, shortage or unavailability of products or raw materials, delay in transit or other causes whatsoever (whether similar to the foregoing or not) beyond the reasonable control of SureCatch.com), SureCatch.com shall be excused and discharged from such performance to the extent of such prevention.

VARIATION OF TERMS AND CONDITIONS

  1. SureCatch.com reserves the absolute right to amend these Terms and Conditions at any and all times in its sole discretion. SureCatch.com may, but does not undertake, to notify the Customer of such changes. It is the Customer's responsibility to review the Terms and Conditions prior to submitting any order and SureCatch.com shall have no responsibility to notify the Customer of any changes to the Terms and Conditions prior to the coming into effect of such changes or otherwise.

LINKS

  1. The SureCatch.com internet site may contain links to other sites and pages. By activating a link, the Customer leaves SureCatch.com site and SureCatch.com does not exercise control over any personal data or any other information the Customer gives to any other entity after leaving the SureCatch.com site and access to such other site or page is at the Customer's own and sole risk for which SureCatch.com absolutely disclaims all responsibility and liability and shall in no way be held liable or responsible or at all.

DISCLAIMER

  1. The information and materials contained in this Site or provided as part of the Services including text, graphics, links or other items, are provided on an "as is" and "as available" basis. SureCatch.com expressly disclaims any and all liability for errors or omissions in such information and/or materials. No warranty of any kind whatsoever and howsoever whether implied, expressed or statutory (including but not limited to the warranties of non-infringement of third party rights and freedom from computer virus) is given in conjunction with such information and/or materials. All information and/or materials found or comprised in this site is purely for informational purposes.
  2.
